| Copyrights & Rules of Design Laws & Practices: A Designers Rights "Be Original" This includes the following: Each week, Gia (Angela) searches the Internet to make sure that her jewelry designs are not copied or replicated. It is against the law to replicate another designers designs/work and then claim and market them as your own. Please keep in mind each design pictured on site is copyrighted. Gia K. has not authorized anyone, including artists, or clothing companies the permission to recreate or duplicate any of her designs for any purpose. Each item in featured on the site was designed by Gia upon customer or clothing line request. Being an artist and jewelry designer is about being original and unique... There have been several questions about the bracelets on Brook Avenue's clothing site. Gia K. designed the bracelets about 3 years ago. She had the idea to combine big chunky stones to make bracelets from black onyx and black-stone for men. In 2006, Gia K. met "Crash" John Matos and was asked to design a total of four bracelets for the Brook Avenue line after sending various bracelet styles to him for review. Out of a total of 8 designs that were originally sent to John Matos of Brook Avenue, only four were selected. Gia K. decided to take the other four designs and add them to her own line of bracelets. The other styles were retired and are owned by Gia K. (Angela). Copyrighted & Protected From Infringement 1.) Original jewelry designs, artwork, and or images: Jewelry, jewelry designs featured on site, photographs of featured items such as crafted jewelry, jewelry designs, hats, clothing, shirts, accessories and purses or whatever is on the site. Each piece of jewelry is first sketched, designed, then dated and has a copyrighted. This means that you may not replicate, copy, duplicate, manufacture, or duplicate any piece of jewelry pictured on site and then claim notoriety or ownership for the items. It is also illegal to claim to take credit for designing jewelry pieces that you did not create! The attempt of replicating/duplicating another person's sole designs (whether it's jewelry or anything tangible) and creations is called, 'Copyright Infringement'. If someone created the designs for you or for themselves to add to their line, then give the actual creator the credit for the design! NOTE: According to law, the moment an item such as works of art such a drawing, lyrics, painting, or a product is created, it is viewed as a tangible item. If an electronic file that records time of date of designed item is created with the aid of pcs, via a library index system, the date that the item was uploaded as an electronic file can serve as proof of creation date. Each item pictured on 'Stoned Soul Urban Jewelry' is first uploaded into a photo library, documented, dated and saved as an electronic file for proof of design and creation date for lega purposes. Any tangible item created for or by the creator/artist/designer are subject to the designers terms and automatically allow the designers and or artist to claim sole copyright. A piece of work is copyrighted the moment the item is invented/crafted. This laws applies to items such as jewelry, drawings, music pieces, paintings, works of art,(tangible property) or even inventions, which are considered as art or... Thus rules applies to even written documents such as songs, poems or etc. These items are also referred to as intellectual (or tangible) property as well. Any items that an artist creates is known and protected as intellectual property under copyright law. Someone cannot come along and copyright another man's or woman's work without their written consent, and agreement upon contract. According to copyright and design laws, items that are created and designed by the reator/artists/designer is protected by federal copyright laws. Please refer to Library of Congress concerning Trademarks, Copyrights rules, and regulations on the matter of sole creations/inventions, intellectual property, and or "artists designs." Also, please refer to the National Jewelry Association rules and regulations concerning laws on copyrighted items and jewelry designs! Remember, an artist's designs is what makes them known and set them aside from the rest. If an items is replicated or copied, it's always correct to give credit to the creator of the invention and not claim it as your own! Additional Rules & Regulations 2.) 'Be Stoned'... " 3.) Pictures of Models and jewelry : Photographs of models posing in sole creations of Angela/Gia K., for Stoned Soul 4.) Layout of site: including material posted on linked sites such as blogs and social networking sites 5.) Names of jewelry pieces, brands and concepts on site... Series of editions and names listed for collections. 6.) All original jewelry styles and designs created by Gia K. (Angela) 7.) Concepts and ideas centered around the designed jewelry. Recently, it was brought to my attention that a few local CSU and UC college association orgs attempted to duplicated my bracelet designs and use them for their own means. This is illegal. It's copyright infringement. You do not have the right to take someone's design, or form and then slap your club or org's logo on it. So I have decided to go after them... What a shame... The situation was handled legally. All items pictured on site, and pictured on fliers, business cards, newsletters, brochures and mailed postal media are all copyrighted, protected, are not to be duplicated/replicated and are sole inventions/designs of Stoned Soul Urban Jewelry Designs. Please also remember that all designs as well have been copyrighted and legal action for copyright infringement will be pursued against anyone who procceds to copy/duplicate/replicate designs pictrued on Stoned Soul Urban Jewelry's website.
